OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to crushing and struck-by hazards:  a) On or about November 20, 2019, at a Southshore Bay residence 5137 Flowing Oar Rd, Wimauma, FL 33598, the employer exposed employees to crushing and struck-by hazards, in that, an employee operating a Moffett M55 forklift to unload concrete blocks had the seat belt interlocking system overridden.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d)  a) On or about November 20, 2019, at the Southshore Bay residence 5137 Flowing Oar Rd, Wimauma, FL 33598, employees were exposed to struck-by hazards, in that the employer did not ensure operators were trained and certified to operate Moffett M55 forklifts.
