If consent is not obtained, the employer shall establish that legally required consent cannot be obtained. When the source individual's consent is not required by law, the source individual's blood, if available, shall be tested and the results documented.  a) Operatory 1: On or about 10/07/19 an employee suffered a needle stick injury to the left hand thumb when she picked up a JM disposable needle in the process of cleaning up a patient care room. Employees clean patient care rooms daily. The employer did not test the source's blood in a feasible time period because they did not establish that legally required consent could not be obtained until, on or about 11/26/2019.
