29 CFR 1926.20(b)(4): The employer shall permit only those employees qualified by training or experience to operate equipment and machinery.   a)  On or about January 16, 2020, an employee was exposed to fall and ejection hazards, while driving a Hitachi ZX360 Excavator, by an unqualified operator.     b)  On or about January 16, 2020, an employee was exposed to fall and ejection hazards, while driving a Hitachi ZX35U-3 Excavator, by an unqualified operator.   c)  On or about January 16, 2020, an employee was exposed to fall and ejection hazards, while driving a Volvo SE-631, by an unqualified operator.   d)  On or about January 16, 2020, an employee was exposed to fall and ejection hazards, while driving a Catepillar 262D3, by an unqualified operator.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:  North side of excavation: On or about January 16, 2020, an employee was exposed to a cave-in hazards while repairing a water drain pipe in an excavation without adequate cave-in protection.

29 CFR 1926.651(j)(2): Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.   East side of excavation: On or about January 16, 2020, an employee was exposed to a struck by hazard while repairing a water pipe in an excavation with equipment less than 2 feet away from the excavation edge.
