29 CFR 1915.73(d): When employees were exposed to unguarded edges of decks, platforms, flats, or similar flat surfaces, more than 5 feet above a solid surface, the edges were not guarded by adequate guardrails meeting the requirements of 29 CFR 1915.71(j)(1) and (2).    (a) Tidewater Barge 73 - Barge 50 - On or about January 21, 2020 and at times prior thereto, employees were exposed to falls of approximately 6' while work and transiting the edge of the barge without guardrails or adequate fall protection.

29 CFR 1915.71(j)(1): Scaffolding, staging, runways, or working platforms which are supported or suspended more than 5 feet above a solid surface, or at any distance above water, were not provided with a railing, which had a top rail whose upper surface was from 42 to 45 inches.    (a) Barge 30 - Upper Mezzanine to the Gold Room - On or about January 21, 20120 and at times prior thereto, employees were exposed to a fall of approximately 9' while working on top of the gold room without adequate guardrails.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.    (a) Barge 30 - Lower Deck - On or about January 21, 2020 and at times prior thereto, employees were exposed to fire and smoke inhalation hazards in that there were no identifiable exit routes in the lower deck of barge 30. In the event of an emergency and/or power outage, employees would not be able to safely egress the lower deck.        NOTE: Abatement certification is required for this item.
