29 CFR 1910.95(d)(1) as referenced in 29 CFR Part 1915 : A representative monitoring program was not developed and implemented when information indicated that an employee's exposure may equal or exceed an 8 hour time weighted average of 85dBA: A representative monitoring program was not developed for an employee with the following exposure: a) Miss Chris Vessel/Outside Hangar: An employee grinding/cutting was exposed to continuous noise levels in excess of the allowable 8-hour time-weighted average sound level (Action Level). The employee's dosimeters dBA level was 78.6% of the permissible level (85dBA) and was equivalent to approximately 88.3 dBA. The sampling was performed for 359 minutes during one shift on 5/6/2020. Zero exposure was assumed for all unsampled time periods. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
