29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance had not been conducted at least once every 3 years. On or about January 30, 2020, employees were exposed to struck-by hazards while operators perform daily routines involving the use of powered industrial trucks and the employer did not ensure operators were evaluated at least once every three years. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
