On or about March 4, 2020, employee(s) completing tasks related to dental bulking in the east building aisleway, was exposed to 0.144 mg/m3 of mercury over a sampling period of 323 minutes, approximately 1.44 times the limit of 0.1mg/m3. Exposure calculations included a zero increment for the 157 minutes not sampled.

29 CFR 1910.1000(e): Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d). a.) On or about March 4, 2020, employee(s) completing tasks related to dental bulking in the east building aisleway, were exposed to 0.144 mg/m3 of mercury over a sampling period of 323 minutes, approximately 1.44 times the limit of 0.1mg/m3. Exposure calculations included a zero increment for the 157 minutes not sampled. The existing control measures, including administrative and engineering controls, were not adequate to limit the exposure of employees to mercury to or below the PEL.

On January 15, 2020, an employee operating a forklift within the plant made contact with a coworker. On January 18, 2020, the employer instructed the employee to operate the forklift to complete material handling, and did not retrain the employee prior to instructing them to continue work.

The employer did not receive written approval from the manufacturer for modifications or additions, which affected the safe operation of the forklift. The employer attached carts on two forklifts within the plant to carry supplied air tanks, and hose reels, that employees could hook up to while operating the forklifts within areas of higher mercury exposure and required supplied air respiratory protection.
