29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury:                                                                                                              A) Exterior, Upper level of the house: An employee was exposed to eye/face injuries while using a pneumatic nail gun and was not protected with any type of eye/face protection, on or about February 12th, 2020.    NOTE: Because abatement of this violation is already documented in the inspection case  file, the employer need not submit certification or documentation of abatement for this  violation as normally required by 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    A) Exterior, Front of the structure: Employees were exposed to fall hazards of approximately 20 feet while using an extension ladder that was not extended at least 3 feet over the landing that they were accessing, on or about February 12th, 2020.   NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR 1926.1053(b)(13): The top or step of a stepladder was used as a step:   A) On the upper level: An employee was exposed to fall/ladder collapse hazards of approximately 7 feet as he was using the top steps of a folding step ladder, on or about February 12th, 2020. 29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     A) Upper level of the structure: Employees were exposed to fall hazards of approximately 20 feet while engaged in framing work on the upper level of a structure without a means of fall protection in place, on or about February 12th, 2020.   Landsmark Construction, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1086959, citation number 1, item number 2 and was affirmed as a final order on March 8th 2016, with respect to a workplace located at 6 Hawthorne Place in Summit, NJ.   NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
