29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent. 29 CFR 1910.95(d)(1): When information indicated that any employee's exposure may equal or exceed an 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a noise monitoring program in order to identify employees for inclusion in the hearing conservation program.  On or about March 12, 2020, a program to monitor employee work tasks and changing work environment due to change in production equipment and work processes, was not developed to ensure continual assessment of noise exposure to employees.  (a)  An employee performing large tank assembly in the large tank assembly area was exposed to a cumulative noise dose of 82.31% during a 414 minute sampling period on March 12, 2020.  This noise exposure equated to an 8-hour hearing conservation program threshold time-weighted average (TWA) sound level of approximately 88.6 dBA, which is above the action level of 85dBA .
