29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:    (a)Toro Construction, LLC at 9020 - 9026 West Wisdom Place, Sioux Falls, SD 57106: On or about and at times prior to March 10, 2020, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were conducting roofing operations on a 5-in-12 pitched roof on a multi-family residence under construction without the use of a fall protection system. This condition exposed employees to fall hazards of approximately 10 to 28 feet.    Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):    (a)Toro Construction, LLC at 9020 - 9026 West Wisdom Place, Sioux Falls, SD 57106: On or about and at times prior to March 10, 2020, the exposing employer did not ensure employees installing roofing material on a 5-in-12 pitched roof on a multi-family home under construction were protected from falls. Employees were working on the roof without a fall protection system. This condition exposed employees to a fall hazard of 10 to 28 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a)Toro Construction, LLC at 9020 - 9026 West Wisdom Place, Sioux Falls, SD 57106: On or about and at times prior to March 10, 2020, the exposing employer did not ensure employees that were exposed to fall hazards above six feet were trained to recognize and minimize hazards. Employees were conducting roofing operations on a 5-in-12 pitched roof on a multi-family residence under construction without the use of a fall protection system. This condition exposed employees to fall hazards of approximately 10 to 28 feet.
