29 CFR 1926.102(a)(1): Eye and face protective equipment were not provided when machines or operations presented potential eye or face injury:  (a) Toro Construction LLC at 6806 East 37th Street, Sioux Falls, SD 57110: On or about and at times prior to August 10, 2021, the exposing employer did not ensure that employees were protected from eye injuries. Employees were permitted to operate pneumatic nail guns while installing roofing materials without wearing eye protection.  This condition exposed employees to eye injuries while utilizing pneumatic nail guns.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a)Toro Construction, LLC at 6806 East 37th Street, Sioux Falls, SD 57110:  On or about and at times prior to August 10, 2021, the exposing employer did not ensure that employees were protected from fall hazards. Employees were engaged in a roofing project on a 6-in-12 roof involving a two-story single-family home without the use of a fall protection system. This condition exposed employees to a fall hazard of greater than 20 feet.  Toro Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1469180, citation number 1, item number 2a, and was affirmed as a final order on August 13, 2020, with respect to a workplace located at 9020 - 9026 West Wisdom Place, Sioux Falls, SD 57106.
