Roberto Benitez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(2), which was contained in OSHA inspection number #1348904, citation number 1, item number 2 and was affirmed as a final order on 03/06/2019, with respect to a workplace located at 5731 Green Arbor Way (Lot #27), Sugar Hill, GA.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) New townhome construction located on Lot #42, Lower Roof: On or about 03/26/2020, the employer exposed employees to fall hazards of 10-feet, 8-inches to the lower level, in that a fall protection system was not provided to employees working from a 2/12 pitched roof engaged in siding installation activities.   b) New townhome construction located on Lot #45, Upper Roof: On or about 03/26/2020, the employer exposed employees to fall hazards of approximately 20-feet to the lower level, in that a fall protection system was not provided to employees engaged in siding installation on the roof.  Roberto Benitez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number #1348661, citation number 1, item number 1 and was affirmed as a final order on 03/06/2019, with respect to a workplace located at 5731 Green Arbor Way (Lot #27), Buford, GA.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) New townhome construction located on Lot #42, Lower Roof: On or about 03/26/2020, the employer exposed employees to fall hazards of 10-feet, 8-inches to the lower level, in that ladders used to access the roof were not extended at least 3-feet past the eave to allow for safe access on and off the roof.     b) New townhome construction located on Lot #45, Upper Roof: On or about 03/26/2020, and at times prior, the employer exposed employees to fall hazards of approximately 20-feet to the lower level, in that ladders used to access the roof were not extended at least 3-feet past the eave to allow for safe access on and off the roof.    Roberto Benitez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number #1348661, citation number 1, item number 2 and was affirmed as a final order on 03/06/2019, with respect to a workplace located at 5731 Green Arbor Way (Lot #27), Buford, GA.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a) New townhome construction located on Lots #42 and #45, Cut Bench on front side: On or about 03/26/2020, employees were exposed to silica dust while operating a Makita (Model 5007MG/SN09082081) 7-1/4-inch circular saw for dry cutting fiber cement siding boards. The employer did not implement engineering and work practice control methods (the use of a saw equipped with commercially available dust collection system with a filter with 99% or greater efficiency), and proper respiratory protection as required by the Table I of the standard.   Roberto Benitez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1153(c)(1), which was contained in OSHA inspection number #1348904, citation number 1, item number 3a and was affirmed as a final order on 03/06/2019, with respect to a workplace located at 5731 Green Arbor Way (Lot #27), Sugar Hill, GA 30518.

The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica to determine if the exposure is at or above the action level of 25 ug/m3.
