29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. a) New townhome construction located on Lots #42 and #45, Cut Bench on front side: On or about 03/26/2020, employees were exposed to silica dust while operating a Makita (Model 5007MG/SN09082081) 7-1/4-inch circular saw for dry cutting fiber cement siding boards. The employer did not implement engineering and work practice control methods (the use of a saw equipped with commercially available dust collection system with a filter with 99% or greater efficiency), and proper respiratory protection as required by the Table I of the standard. Roberto Benitez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1153(c)(1), which was contained in OSHA inspection number #1348904, citation number 1, item number 3a and was affirmed as a final order on 03/06/2019, with respect to a workplace located at 5731 Green Arbor Way (Lot #27), Sugar Hill, GA 30518.
