29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a.) On or about May 12, 2020, employees were exposed to fall hazards measured to be 8 feet 5 inches and 17 feet 5 inches while removing and replacing asphalt shingles on a residential roof without utilizing a fall protection system.

29 CFR 1926.502(a)(2): Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection. a.) On or about May 12, 2020, the employer did not to install a fall protection system before employees began re-roofing work on a residential roof structure and exposing employees to a 8 foot 5 inch and 15 foot 7 inch fall hazard.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. a.)
