29 CFR 1926.651(h)(1): Employees shall not work in excavations in which there is accumulated water, or in excavations in which water is accumulating, unless adequate precautions have been taken to protect employees against the hazards posed by water accumulation.   a. On or about May 14, 2020, located at 9905 SR-104, Lockbourne, Ohio, an employee was capping a water line in an excavated trench that had over 1 foot of water accumulated in the bottom section in which the employee was working. There was a heavy rain and it was raining at the time of the inspection as well. There were no adequate precautions in place to protect the employee from water accumulation thereby exposing the employee to caught-between and/or struck-by hazards associated with trench collapse.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated.  a. On or about May 14, 2020, located at 9905 SR-104, Lockbourne, Ohio, an employee was capping a water line in an excavated trench of approximately 5 foot, 6 inches in depth that had water accumulated from a heavy rain storm that had not been inspected prior to entrance. The trench had no cave-in protection and there was clear and known water accumulation in the excavated trench and it was actively raining at the time of the inspection.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section.  a. On or about May 14, 2020, located at 9905 SR-104, Lockbourne, Ohio, an employee was capping a water line in an excavated trench of approximately 5 foot 6 inches at its greatest depth with no cave-in protection in place. There was clear and known water accumulation in the trench.
