29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: a) USS Vicksburg: On about 04/28/2020, employees' mechanically removed paint that contained 5.60% Zinc, the employer did not evaluate and reasonable estimate the employees' respiratory hazard therefore employees' were possibly exposed to greater than 5 mg/m3 of respirable dust. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1915.15(c): A competent person did not visually inspect and test each space certified as "Safe for Workers" or "Safe for Hot Work" as often as necessary to ensure that atmospheric conditions within that space were maintained within the conditions established by the certificate: a) USS Vicksburg, Tank 6-272-1-F: On about 05/01/2020, the employer failed to conduct visual inspects and test as often as necessary to determine as a result employees were exposed to excessive smoke/particulates generated by air powered needle guns and electric grinder/cutting wheels used in the removal of paint and metal. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
