29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) Guarquila Construction LLC, at a jobsite located at 6964 Hanby's Loop Lot 42, New Albany, Ohio 43054: On and/or preceding June 2, 2020, the employer failed to initiate and maintain a safety and health program such as, but not limited to, a fall protection program for employees conducting framing work.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a) Guarquila Construction LLC, at a jobsite located at 6964 Hanby's Loop Lot 42, New Albany, Ohio 43054: On and/or preceding June 2, 2020, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees were working on the first floor where the stairwell opening to the basement was not guarded, thereby exposed to fall hazards of 10 feet.
