29 CFR 1926.453(b)(2)(v): Extensible and articulating boom platforms. A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). On June 11, 2020 at W450 Co Rd KK in Kaukauna, an employee was utilizing a Genie aerial lift basket to access/egress a roof surface twelve feet above surface level without utilizing personal fall arrest system or restraint system equipment.

29 CFR 1926.453(b)(2)(iv): Extensible and articulating boom platforms. Employees shall always stand firmly on the floor of the basket, and shall not sit or climb on the edge of the basket or use planks, ladders, or other devices for a work position. On June 11, 2020 at W450 Co Rd KK in Kaukauna, an employee was climbing on the mid-rail around the outside of a Genie aerial lift basket fourteen feet above surface level; the basket was positioned between a porch roof and a garage roof as part of a path between the two roof surfaces.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a) On June 11, 2020 at W450 Co Rd KK in Kaukauna, an employee was working on a steep roof surface with unprotected edges without utilizing fall protection equipment; gable eave edge at ridge twenty-five feet above surface level and sidewall eave edge thirteen and one half feet above surface level. b) On June 11, 2020 at W450 Co Rd KK in Kaukauna, an employee who was retrieving materials was walking on a low slope roof surface at twelve feet above surface level without utilizing fall protection equipment.
