29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): (a) Nery's Construction at 233 N Main Street in Brighton, CO 80601: On June 10, 2020 the employer did not ensure that employees were protected from injury, in that five employees installing new decking on a three-story apartment building with a roof pitch of approximately 4-in-12, were not utilizing any fall protection systems. This condition exposed five employees to a fall hazard of approximately 25-30 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) Nery's Construction at 233 N Main Street in Brighton, CO 80601: On June 10, 2020 the employer did not ensure that employees were trained to use fall protection systems when working at heights above 6 feet in that five employees installing new decking on a three-story apartment building were not utilizing any fall protection systems for approximately four hours. This condition exposed five employees to a fall hazard of approximately 25-30 feet.
