29 CFR 1926.62(e)(2)(i): The employer did not establish and implement a written compliance program to achieve compliance with 29 CFR 1926.62(c) prior to commencement of the job: On or about June 1st, 2020, and at times prior thereto and thereafter, the employer had not implemented a written compliance program to ensure workers removing lead-based paint were not exposed to airborne lead dust at or above the Permissible Exposure Limit (50 ug/m3), exposing workers to the hazard of inhaling lead dust. Elements of a written compliance program not implemented include, but are not limited to: 1926.62(e)(2)(ii)(A): Description of activities which emit lead, including controls and operating procedures; 1926.62(e)(2)(ii)(D): Air monitoring data which documents the source of lead emissions; 1926.62(e)(2)(ii)(F): Protective work clothing and equipment; 1926.62(e)(2)(ii)(H): Description of arrangement among contractors on multi-contractor sites with respect to responsibility for compliance with section 1926.62
