OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by or crushing hazard when operating forklifts without the use of a restraint device:   a) On or about September 25, 2020 and at times prior thereto employees operated the JCB Rough Terrain powered industrial truck (forklift) without using the seatbelt.

29 CFR  1926.754(e)(2)(iii): Metal decking holes and openings were cut and not immediately covered or permanently filled with the equipment or structure needed to fulfill its specific use which meets the strength requirements of paragraph (e)(3) of this section.   (a)  Valley View Elementary:  On or about September 25, 2020, and at times prior thereto, employees performing structural steel activities on the metal deck were exposed to four (4) open penetrations that were not covered and/or permanently filled and exposed to a fall hazard to a concrete floor below.
