29 CFR 1926.451(b)(2): Scaffold platforms and walkways were not at least 18 inches wide:  a) On or about October 3, 2020, at the jobsite, one employee was exposed to fall hazards, in that, they were using a 2x10 plank placed between two A-frame ladders to install vinyl siding. The plank was approximately 9.5 inches wide.

29 CFR  1926.451(f)(3):Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:  a) On or about October 3, 2020 at the jobsite, employees constructed a scaffold using two (2) 6 foot A-Frame Werner NXT1A06 Ladders with a 2x10 plank of wood connecting them for the employee to work from. The scaffold components were not inspected for visible defects by a competent person which lead to a failure of the plank of wood.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:  a) On or about October 3, 2020, at the jobsite, an employee was exposed to fall hazards when using a two (2) 6 foot A-Frame Werner NXT1A06 step ladders approximately 5 feet apart with a 2x10 plank set on the fourth rung from the bottom to access height for installing vinyl siding. The manufacturer did not intend for the ladder to be used as a scaffold with a plank connecting the two ladders.

29 CFR  1904.39(a)(2):The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours.  a) On or about October 3, 2020 at 3004 SW 7th Ave, Cape Coral, FL, an employee suffered a work-related injury and was hospitalized.  The employer was aware of the in-patient hospitalization on October 3, 2020. The employer notified OSHA on October 5, 2020 of the work related hospitalization.
