29 CFR 1926.20(b)(2): The employer did not initiate and maintain an accident prevention program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a)Landscape Garden Centers, Inc. at 47238 271st Street, Sioux Falls, SD 57108: On or about and at times prior to October 15, 2020, the controlling employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Subcontractor employees were exposed to fall hazards of approximately 16 feet while installing steel corrugated roof panels over wood purlins without the use of a fall protection system. Additionally, the subcontractor employees were exposed to fall hazards while being elevated on an inadequate personnel platform connected to a rough terrain forklift to gain access to the roof. Subcontractor employees were not provided ladders and climbed through the roof into the webbing of the trusses and down walls to get to the ground. The condition exposed employees to a fall hazard of approximately 16 feet and 25 feet Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
