29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  a. On or about October 28, 2020, on Packing Line 1, employees were performing maintenance on the back of the line to clear a jam without being protected from falls to the lower level. Employees were thereby exposed to fall hazards of greater than 6 feet.

29 CFR  1910.147(c)(4)(ii)(B): The energy control procedures did not clearly and specifically outline the steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy.  a. On or about October 28, 2020, and at times prior, on Packing Line 1, employees performed maintenance and servicing with an inadequate energy control procedure. The energy control procedure for Packing Line 1 did not clearly and specifically outline the steps for isolating and releasing the pneumatic energy associated with the line, such as, but not limited to, stored pneumatic energy in the air trolley cylinders.

29 CFR  1910.147(c)(7)(i)(A): Authorized employee(s) did not receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control:  a. On or about October 28, 2020, and at times prior, on Packing Line 1, authorized employees who performed maintenance and servicing activities such as, but not limited to, cleaning, clearing jams, troubleshooting, and regular maintenance, had not received adequate training. Employees were not trained on the methods and means necessary for isolating and controlling stored pneumatic and hydraulic energy on Packing Line 1. As a result, employees were exposed to hazards associated with the machinery such as, but not limited to, caught-between, struck-against, and struck-by associated with moving parts.  b. On or about October 28, 2020, on Packing Line 1, an employee was involved in clearing a jam on the backside of the line, and had not received training in the recognition of hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control. As a result, the employee was exposed to machine hazards such as, but not limited to, caught-between, struck-against, and struck-by associated with moving parts.

As a result, employees were exposed to potential struck-by or caught-in/between hazards associated with uncontrolled hazardous energy sources such as, but not limited to, electrical, pneumatic and hydraulic.  b. On or about November 23, 2020, and at times prior, employees who worked on Packing Line 2 were not instructed on the purpose and use of energy control procedures. As a result, employees were exposed to potential struck-by or caught-in/between hazards associated with uncontrolled hazardous energy sources such as, but not limited to, electrical, pneumatic and hydraulic.

29 CFR  1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) was not done in sequence as required by 29 CFR 1910.147(d)(1) through (d)(6):  a. On or about October 28, 2020, on Packing Line 1, employees were exposed to machine hazards associated with moving parts while clearing a jam on the backside of the line. The employer failed to implement energy control application steps as all energy isolating devices that were needed to control the energy to the machine were not utilized prior to clearing the jam on the machine [per the 1910.147(d)(3) requirements]. As a result, the remaining applicable energy control elements involving LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)(i)], and verification of isolation [(d)(6)] were not performed.

29 CFR  1910.147(f)(3)(ii)(D): Each authorized employee shall affix a personal lockout or tagout device to the group lockout device prior to working on the machine or equipment:  a. On or about October 28, 2020, and at times prior, on Packing Line 1, three authorized employees were working to clear jammed molds on the backside of the line. Each authorized employee did not affix their own personal lockout or tagout device to a group lockout device prior to working on the line.
