29 CFR  1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a). KSM Contractors, LLC - Employees were observed working out of the dump box of an Equiptor RB4000 elevated approximately 6 feet from ground level. The Equipter RB4000 is not designed by the manufacturer to be used as a personnel lift and the employer failed to instruct each employee in the appropriate use of the equipment, on or about  November 13, 2020.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR  1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, a personal fall arrest system, or an alternative fall protection measure as provided by another provision in paragraph (b) of this section:  a). KSM Contrators, LLC, at 127 Bobby Lane, Halifax, PA - The employer did not provide fall protection for employees working on a 4:12 pitch roof approximately7-12 ft. from ground level, on or about November 13, 2020.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.
