29 CFR  1926.20(b)(1):   Accident prevention responsibilities:  It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  On November 18, 2020 at W6807 Design Drive in Greenville, Wisconsin, the employer did not initiate and maintain safety programs for employees exposed to fall hazards and operating powered industrial vehicles.

29 CFR  1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  On November 18, 2020 at W6807 Design Drive in Greenville, Wisconsin, the employer did not provide required fall protection safety training for employees exposed to fall hazards greater than six feet while framing a two story residential home.

Note: The requirements applicable to construction work under this paragraph are identical to those set forth at ��1910.178(l) of this chapter.  Reference:  29 CFR  1910.178(l)(4)(iii):  An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years.  On November 18, 2020 at W6807 Design Drive in Greenville, Wisconsin, the employer did not ensure the JCB 509-42 Telehandler operator had a current performance evaluation within three years.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  a)  On November 18, 2020 at W6807 Design Drive in Greenville, Wisconsin, employees were working from trusses' bottom chords at nine feet above surface level without utilizing fall protection equipment.  b) On November 18, 2020 at W6807 Design Drive in Greenville, Wisconsin, employees were working from exterior wall top plates at thirteen feet above surface level  and/or from interior wall top plates at nine feet above surface level without utilizing fall protection equipment.  c)  On November 18, 2020 at W6807 Design Drive in Greenville, Wisconsin, employees were walking in first floor areas that had exterior wall openings with bottom outside edges nine feet above surface level with no form of fall protection utilized.  d)  On November 18, 2020 at W6807 Design Drive in Greenville, Wisconsin, employees were walking in first floor areas with an unprotected floor hole ten feet nine inches above basement surface level with no form of fall protection equipment utilized.
