29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  (a) SHA MSL Greendale, LLC DBA Clifden Court Senior Living, 6801 W Loomis Road, GREENDALE, WI 53129:  On or about January 7, 2021,  and thereafter,  the employer did not provide a medical evaluation to determine each employee's ability to use a respirator before requiring the use.  The employer required employees to wear respirators while providing care to suspected and confirmed positive COVID-19 patients and residents.

29 CFR  1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator:  (a) SHA MSL Greendale, LLC DBA Clifden Court Senior Living, 6801 W Loomis Road, GREENDALE, WI 53129:  On or about January 7, 2021 and thereafter, the employer did not provide a fit test to all employees required to wear respirators.  The employer required employees to wear N95 or KN95 filtering facepiece respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 patients and residents.

29 CFR  1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a) On or about January 21, 2021, the Hazard Communication Program provided did not incorporate the Globally Harmonized System (GHS) of Classification and Labelling of Chemicals of the Hazard Communication Standard of 2012. The Hazard Communication Program did not reference chemical Safety Data Sheets, pictograms, signal words, hazard classification, and warning statements found on chemical labelling.
