29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) Lagunas Framing LLC., at a jobsite located at 7125 Sea Breeze West, Building 5, Sunbury, Ohio 43074. On and/or preceding January 27, 2021, the employer failed to initiate and maintain a safety and health program such as but not limited to a fall protection program for employees conducting framing work.

29 CFR  1926.453(b)(2)(v):A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift.  Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  a) Lagunas Framing LLC., at a jobsite located at 7125 Sea Breeze West, Building 5, Sunbury, Ohio 43074. On and/or preceding January 27, 2021, the employer did not ensure employees were protected from falls while working from aerial lifts. An employee was working from an elevated aerial lifts without fall protection while installing sheathing to the 2nd story of a three story apartment building, thereby exposed to fall hazards of up to 30 feet.
