29 CFR 1926.20(b)(2):Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On February 18, 2021, located on a commercial structure, employees were exposed to a fall hazard while performing work from inside an aerial lift basket not wearing a harness and lanyard attached to the basket. The employer did not designate a competent person to provide frequent and regular inspections to ensure the job-site, materials, and equipment such as fall protection systems and/or devices were being maintained and utilized in a safe condition. Potential fall height measured to be 18 feet. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.453(b)(2)(v):A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). On February 18, 2021, located on a commercial structure, employees were exposed to a fall hazard while working inside a JLG Telescopic Boom Lift basket Model# 460SJ without being attached to the boom or basket. Potential fall height measured to be 18 feet.
