29 CFR  1910.212(a)(2):General requirements for machine guards. Guards shall be affixed to the machine where possible and secured elsewhere if for any reason attachment to the machine is not possible. The guard shall be such that it does not offer an accident hazard in itself.  On or about February 8, 2021 and times prior, there were no guards in place on the Magna shear, model no. H-12014 serial no. 5961, to prevent employees from placing fingers in the under the clamp or in the point of operation.

29 CFR  1904.4(a):Basic requirement. Each employer required by this Part to keep records of fatalities, injuries, and illnesses must record each fatality, injury and illness.  Located at Sign America Inc. in Richmond, OH:  On or about March 16, 2021, the employer did not record an injury on the 2021 OSHA 300 log. On or about February 8, 2021, an employee sustained an amputation to the tip of the left middle finger while operating a shear.

29 CFR  1904.39(a)(2):Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.  Located at Sign America Inc. in Richmond, OH:  The employer did not report an employee amputation within 24 hours of the knowledge of the amputation. On or about February 8, 2021 an employee sustained an amputation to the finger while using a shear.
