29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to SARS-CoV-2 (severe acute respiratory syndrome coronavirus 2), the cause of the COVID-19 disease.    a) AMA Health Holdings, LLC dba Seaside Guest Services  On 2/24/2021 and thereafter,  the employer did not develop and implement effective measures to mitigate the spread of SARS-CoV-2, the virus that causes Coronavirus Disease 2019 (COVID-19).  The employer did not timely identify residents who presented symptoms and test them for COVID-19.  The employer transferred symptomatic COVID-19 positive residents to the Vanderbilt House and assigned employees to work there without enforcing COVID-19 isolation protocols.   Approximately eleven (11) employees and twenty-eight (28) residents contracted COVID-19.     ABATEMENT DOCUMENTATION AND ABATEMENT CERTIFICATION REQUIRED FOR THIS ITEM

29 CFR 1904.4(a): The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent.    a) At the facility, AMA Health Holdings, LLC DBA Seaside Guest Services in Tinton Falls, NJ: On or about 2/22/2021 the employer did not record a work related illness of a Food Service Manager who tested positive for COVID-19 on 2/15/2021 and had lost 21 lost work days on the OSHA 300 log or its equivalent.   b) At the facility, AMA Health Holdings, LLC DBA Seaside Guest Services in Tinton Falls, NJ: On or about 3/2/2021 the employer did not record a work related illness of a Driver who tested positive for COVID-19 on 2/23/2021 and had lost 27 lost work days on the OSHA 300 log or its equivalent.   c) At the facility, AMA Health Holdings, LLC DBA Seaside Guest Services in Tinton Falls, NJ: On or about 3/3/2021 the employer did not record a work related illness of a Behavioral Technician who tested positive for COVID-19 on 2/24/2020 and had lost 18 lost work days on the OSHA 300 log or its equivalent.   d) At the facility, AMA Health Holdings, LLC DBA Seaside Guest Services in Tinton Falls, NJ: On or about 3/04/2021 the employer did not record a work related illness of a Driver who tested positive for COVID-19 on 2/25/2021 and had lost 14 lost work days on the OSHA 300 log or its equivalent.   e) At the facility, AMA Health Holdings, LLC DBA Seaside Guest Services in Tinton Falls, NJ: On or about 3/10/2021 the employer did not record a work related illness of a Behavioral Technician who tested positive for COVID-19 on 3/03/2021 and had lost 25 lost work days on the OSHA 300 log or its equivalent.   f) At the facility, AMA Health Holdings, LLC DBA Seaside Guest Services in Tinton Falls, NJ: On or about 3/10/2021 the employer did not record a work related illness of a Behavioral Technician who tested positive for COVID-19 on 3/03/2021 and had lost 15 lost work days on the OSHA 300 log or its equivalent.   g) At the facility, AMA Health Holdings, LLC DBA Seaside Guest Services in Tinton Falls, NJ: On or about 7/28/2021 the employer did not record a work related illness of a Nurse Practitioner who tested positive for COVID-19 on 7/21/2021 and has not yet returned to work.  h) At the facility, AMA Health Holdings, LLC DBA Seaside Guest Services in Tinton Falls, NJ: On or about 7/28/2021 the employer did not record a work related illness of aNursePractitioner who tested positive for COVID-19 on 7/21/2021 and has not yet returned to work.  i) At the facility, AMA Health Holdings, LLC DBA Seaside Guest Services in Tinton Falls, NJ: On or about 7/28/2021 the employer did not record a work related illness of a Nurse Practitioner who tested positive for COVID-19 on 7/21/2021 and has not yet returned to work.
