OSH Act of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that the employer allowed employees who were potentially exposed to SARS-CoV-2 to congregate in close proximity to each other at the workplace.  The employer did not enforce the employer-developed COVID-19 prevention policy of masks and social distancing when possible while employees worked in the plant. Employees were congregating in close proximity without face coverings in areas including, but not limited to, time clocks, lunchrooms, a crane cab, and the control rooms. Close proximity between employees occurred on multiple times daily and during shift changes.  Among other methods, feasible and acceptable means of abatement for this hazard include: Employees should wear a mask pursuant to CDC Guidelines.  Implement and enforce the requirement for employees to maintain a physical distance of at least 6 feet from co-workers. A physical barrier should be used to separate workers when physical distancing cannot be maintained. Transparent shields or other solid barriers (e.g., fire resistant plastic sheeting or flexible strip curtains) can separate workers from other people.  Improve ventilation systems in common spaces and small rooms. Provide filtering and air exchange of the indoor building air in order to provide acceptable air quality for each work space.  Retrain managers and re-evaluate existing company procedures to ensure that face coverings are being used and physical distancing is being maintained when feasible to protect employees from someone with SARS-CoV-2 infection in the workplace.
