OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crushed-by and/or struck-by hazards.  On or about April 1, 2021, the employer did not ensure employees were protected from under-ride hazards associated with operating standup forklifts.  Raymond Reach Trucks (Forklift, Model 730-R45TT and Model 750-R45TT) were not equipped with rear post guards, or other feature to prevent an under-ride from occurring nor did the employer adjust the shelf heights so that the overhead guard or bottom of the forklift would strike the rack in the event of contact.
