General-duty citation text
29 CFR OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from an improperly positioned and unsecured fork tine on a pallet fork attachment, that injured an equipment operator. Location: Jobsite Instance # 1 : An employee sustained serious leg injuries while working, where a fork tine had not been properly secured with the locking assembly set in the notch on the top rail of the pallet fork attachment. Instance # 2 : Employees were exposed to struck-by and crushing hazards while working, where the right and left fork tine had not been set equal distances from the center of the pallet fork attachment.
