29 CFR  1926.20(b)(1):The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  a) Mendez Brothers Roofing located at 2182 East Livingston Ave. Columbus, OH 43209: On and preceding April 16, 2021,  employees were performing roof repairs on a single story commercial building at heights up to 12 feet without fall protection and improperly configured ladders. The employer did not initiate and maintain safety and health programs related to the roofing work being conducted by employees.

29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.   a) Mendez Brothers Roofing located at 2182 East Livingston Ave. Columbus, OH 43209: On and preceding April 16, 2021, the employer did not ensure that employees engaged in commercial construction activities 6 feet or more above lower level were protected from falls. Roofers were performing roof repairs on a single story commercial building at heights up to 12 feet without fall protection, warning lines or a safety monitor.  The following condition exposed them to falls up to 12 feet.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) Mendez Brothers Roofing located at 2182 East Livingston Ave. Columbus, OH 43209: On and preceding April 16, 2021, the employer did not ensure that the ladder used for access to the roof extended at least three feet beyond the surface they were accessing. Roofers were using an extension ladder to access the roof of a single story commercial building with the ladder extending approximately 28 inches beyond the upper landing and was not secured in any way. The following condition exposed them to falls up to 12 feet.
