29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) Gutierrez Construction Company L.P., at a jobsite located at 6419 Low Tide, Lot 79, Westerville, Ohio 43081: On and/or preceding April 22, 2021, the employer did not initiate and maintain a safety and health program such as but not limited to an electrical safety program and fall protection program to ensure detection and correction of hazards during construction activities.

The path to ground from circuits, equipment, and enclosures shall be permanent and continuous.  a) Gutierrez Construction Company L.P., at a jobsite located at 6419 Low Tide, Lot 79, Westerville, Ohio 43081: On and/or preceding April 22, 2021, the employer did not ensure employees who used electrically operated tools and equipment were protected from electrical contact hazards. Framers were using an extension cord with the ground prong missing from the end of a cord, which exposed the employees to a 114 volt electrical contact hazard.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a) Gutierrez Construction Company L.P., at a jobsite located at 6419 Low Tide, Lot 79, Westerville, Ohio 43081: On and/or preceding April 22, 2021, the employer did not ensure employees were protected from falls while engaged in residential construction activities. An employee was installing the second floor joists while working from the top plate of the walls. The employee was not protected from falls by any means, thereby exposed to a 12 foot 9 inch fall hazard.
