29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) Gutierrez Construction Company L.P., at a jobsite located at 616 Habitat War, Lot 1514, Sunbury, Ohio 43074: On and/or preceding February 16, 2022, the employer did not initiate and maintain a safety and health program such as but not limited to a fall protection program to ensure detection and correction of hazards during construction activities.  Gutierrez Construction Company L.P was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1526822, citation number 1, item number 1 and was affirmed as a final order on June 17, 2021, with respect to a workplace located at 6419 Low Tide, lot 79, Westerville, OH 43081.

29 CFR  1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a) Gutierrez Construction Company L.P., at a jobsite located at 616 Habitat War, Lot 1514, Sunbury, Ohio 43074: On and/or preceding February 16, 2022, the employer failed to train employees on the hazards found on the worksite or the procedures to control or eliminate the hazards for employees conducting framing work.  Gutierrez Construction Company L.P was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.21(b)(2), which was contained in OSHA inspection number 1526822, citation number 1, item number 2 and was affirmed as a final order on June 17, 2021, with respect to a workplace located at 6419 Low Tide, lot 79, Westerville, OH 43081.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a) Gutierrez Construction Company L.P., at a jobsite located at 616 Habitat War, Lot 1514, Sunbury, Ohio 43074: On and/or preceding February 16, 2022, the employer did not ensure employees were protected from falls while engaged in residential construction activities. An employee was installing the second floor joists while working from the top plate of the walls. The employee was not protected from falls by any means, thereby exposed to a 12 foot 3 inch fall hazard.  b) Gutierrez Construction Company L.P., at a jobsite located at 616 Habitat War, Lot 1514, Sunbury, Ohio 43074: On and/or preceding February 16, 2022, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employee were working on the first story where the guardrail system was not compliant for the stairway opening, thereby exposed to a 10 foot fall hazard.  Gutierrez Construction Company L.P was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.21(b)(2), which was contained in OSHA inspection number 1526822, citation number 1, item number 4 and was affirmed as a final order on June 17, 2021, with respect to a workplace located at 6419 Low Tide, lot 79, Westerville, OH 43081.
