29 CFR  1910.178(l)(1)(ii):Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).  On or about April 29, 2021 and times before, the employer did not ensure all employees and vendors completed the required training prior to allowing them to operate powered pallet jacks.

29 CFR  1910.178(l)(4)(iii):An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years.  On or about April 29, 2021, the employer did not conduct an evaluation of each powered industrial truck operator at least once every three years.  Kroger was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.178 (l)(4)(iii), which was contained in OSHA inspection number 1368405, citation number 1, item number 1-b and was affirmed as a final order on February 4, 2019, with respect to a workplace located at 1001 Cherry St, Blanchester, OH 45107.
