29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a. On or about 04/29/2021 at Gull Blvd and Medical Arts Court Intersection, Zephyrhills, FL 33541, employees were exposed to the hazard of being struck by an excavator/loader, in that, equipment operators were not trained as required so they can safely operate equipment on slopes such as, but not limited to, a 25 degree shoulder incline.

29 CFR 1926.602(a)(3)(i): Construction equipment or vehicles were moved upon an access roadway or grade without ensuring the access roadway or grade was constructed and maintained to safely accommodate the movement of equipment and vehicles involved.  a. On or about 04/29/2021 at Gull Blvd and Medical Arts Court Intersection, Zephyrhills, FL 33541, employees were exposed to the hazard of being struck by an excavator/loader, in that, a loader/excavator was operated on an 25 degree incline while hoisting an auger without assuring that the grade could safely support the equipment and load without tipping over.
