29 CFR 1926.251(a)(2)(i): The employer did not ensure that rigging equipment had permanently affixed, and legible identification markings as prescribed by the manufacturer that indicate the recommended safe working load:  a) On or about December 4, 2024, New commercial construction located at Universal Epic Orlando (Epic Solar Panel Site) Orlando Florida 32819, employees were allowed to utilize a spreader bar and shackles that did not have permanently affixed and /or legible markings on them.   b) On or about December 6, 2024, construction site located at the intersection of cross streets of Destination Parkway and Constellation Way located in front of Universal Epic Orlando employees were allowed to utilize a spreader bar and shackles that did not have permanently affixed and /or legible markings on them.

29 CFR 1926.1434(a): Modifications or additions which affect the capacity or safe operation of the equipment were not prohibited except where the requirements of paragraphs (a)(1), (a)(2), (a)(3), (a)(4), or (a)(5) of this section were met:  a) On or about December 4, 2025, New commercial construction located at Universal Epic Orlando (Epic Solar Panel Site) Orlando Florida 32819, employees were allowed to operate a 900A stand-Up truck serial number 32353 (C22) that was modified with a water box and was not approved by the manufacturer.  b) On or about December 6, 2024, construction site located at the intersection of cross streets of Destination Parkway and Constellation Way located in front of Universal Epic Orlando employees were allowed to operate a 900A stand-Up truck serial number 32353 (C22) that was modified with a water box and was not approved by the manufacturer.

29 CFR  1926.602(c)(1)(ii): Modifications or additions affecting the safe operation of the equipment were  made without the manufacturer's written approval :Note:  If such modifications or changes were made, the capacity, operation, and maintenance instruction plates, tags, or decals should have been changed accordingly  a) Employees were exposed to struck-by hazards as well as crushing hazards, in that employer allowed the use of  a self made sling box holder to be attached to the frame of the of the Genie forklift model GTH844 serial#GTH0815-20919, without written approval from the manufacturer.  b)  Employees were exposed to struck-by hazards as well as crushing hazards, in that employer allowed the use of  a lifting device that attached to the front forks of the of the Genie forklift model GTH844 serial#GTH0815-20919, without written approval from the manufacturer.

29 CFR  1926.1412(f)(1):  The equipment was not inspected at least every 12 months by a qualified person in accordance with paragraph (d) of this section.  a) On or about December 4,  2024 , New commercial construction located at Universal Epic Orlando ( Epic Solar Panel Site) Orlando Florida 32819, the employer exposed employees to struck-by hazards while using a the 900A stand-up boom crane to lift round steel concrete forms in that the employer did not perform annual inspections of the crane by a competent person and did not inspect the crane and related equipment for deficiencies prior to the start of operations on site.   b) On or about December 6,  2024 , construction site located at the intersection of cross streets of Destination Pkwy and Constellation Way located in front of Universal Epic Orlando employer exposed employees to struck-by hazards while using a the 900A stand-up boom crane to lift round steel concrete forms in that the employer did not perform annual inspections of the crane by a competent person and did not inspect the crane and related equipment for deficiencies prior to the start of operations on site.
