29 CFR  1926.701(b):All protruding reinforcing steel, onto and/or into which employees could fall, was not guarded to eliminate the hazard of impalement:  a) On or about 5/20/2021, at the concrete side walk area of the site, Cheektowaga, NY. Three-quarter inch round reinforcing steels, that were used as form supports, were not guarded for impalement hazard. Employees were working from the ground on concrete placement of the side walk, and the working area had minimal tripping hazard.  NO ABATEMENT CERTIFICATION REQUIRED
