29 CFR 1926.20(b)(1):The employer did not initiate and maintain accident prevention programs as necessary to comply with this part: Metal Stud Erectors, Inc. at the worksite located at 5410 Milan Rd. in Sandusky, OH: On or about June 9, 2021, the employer did not implement a plan or safety program to identify job site hazards for employees to maintain a safe working environment. Such a program would allow the employer to identify potential hazards such as falls during job site operations, decreasing the probability of employee injury. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.761(b):The employer did not train each employee exposed to a fall hazard in accordance with the requirements of 29 CFR 1926.761: Metal Stud Erectors, Inc. at the worksite located at 5410 Milan Rd. in Sandusky, OH: On or about June 9, 2021, the employer did not ensure that employees had been trained in the recognition of fall hazards commonly created during the construction of metal buildings. Employees unfamiliar with the requirements of fall protection while performing framing operations were exposed to falls of approximately 24-feet. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
