29 CFR  1926.102(a)(1):  The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about 6/09/2021, employees from Gustavo Angel Cabrera-Marquez were installing shingles on a detached garage located at 506 Meadow Field Court in Wentzville, MO. Gustavo Angel Cabrera-Marquez, the owner, and two employees were not utilizing eye protection while using pneumatic nail guns to fasten shingles to the roof.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest systems.  On or about 6/09/2021, employees from Gustavo Angel Cabrera-Marquez were installing shingles on a detached garage located at 506 Meadow Field Court in Wentzville, MO. They were not utilizing guardrail systems, a safety net system, or personal fall arrest systems.   Gustavo Angel Cabrera-Marquez, the owner, and three employees were observed working from 5/12 sloped roof approximately ten to seventeen feet above the ground without utilizing fall protection.

29 CFR  1926.1053(b)(1):  When portable ladders are used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access.  On or about 6/09/2021, employees from Gustavo Angel Cabrera-Marquez were installing shingles on a detached garage located at 506 Meadow Field Court in Wentzville, MO. Gustavo Angel Cabrera-Marquez, the owner, and three employees were using an extension ladder to access the roof.  The ladder was not extended three feet beyond the landing surface or edge of the roof.
