OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm in that employees were exposed to excessive heat while working outdoors: a) On or about July 14, 2021, employees were exposed to excessive heat outside with an air temperature of 89�F, heat index of 98.9�F, and WBGT of 87.8�F while performing moderate category work tasks associated with tree trimming activities.
