29 CFR  1910.28(b)(3)(i):  The employer did not ensure that each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following methods listed in 29 CFR 1910.28(b)(3)(i)(A)-(D):  a) Jewell Grain located at 259 East High Street in Hicksville, Ohio;   On or about July 14, 2021 the employer did not ensure employees were protected from tripping into or stepping into or through any hole that is more than 4 feet above a lower level by a cover or guardrail system. Employees entering bin #18, a flat bottom grain storage structure, were exposed to a fall of approximately six feet through exit gates located on the floor of the bin.

29 CFR  1910.147(c)(7)(i):The employer did not provide adequate training to ensure that the purpose and function of the energy control program was understood by employees:  a) Jewell Grain located at 259 East High Street in Hicksville, Ohio;   On or about July 14, 2021 the employer did not ensure that employees who engage in group lock out tag out activities were adequately trained in the skills required for the safe application, usage, and removal of energy controls. Employees were exposed to engulfment and entrapment hazards in that each employee engaged in cleaning activities inside of grain bin #18 did not apply a personal lock out tag out device.

29 CFR  1910.147(f)(3)(i):A procedure was not utilized to afford the employees a level of protection equivalent to that provided by the implementation of a personal lockout or tagout device when servicing and/or maintenance was performed by a crew, craft:  a) Jewell Grain located at 259 East High Street in Hicksville, Ohio;   On or about July 14, 2021 the employer did not ensure that procedures were utilized while engaged in cleaning activities inside grain storage bins which affords each employee involved a level of protection equivalent to that provided by the implementation of a personal lockout device. Employees were exposed to engulfment and entrapment hazards in that each employee engaged in cleaning activities inside of grain bin #18 did not apply a personal lock out tag out device.
