29 CFR 1904.40(a):The employer did not provide an authorized government representative the records within the four business hours. Archer Daniels Midland Company failed to provide their OSHA 300 Logs and Form 300A for their facility located at 7800 Thayer Street, Lincoln, NE 6850 to an authorized OSHA representative within four hours of the representative making both an oral informal and a formal written request for said documents. Instances of failure to respond include but are not limited to: i. On or about February 25, 2026, when OSHA made a verbal request to the company during the opening conference. ii. On or about February 25, 2026, when OSHA made a written request to the company via email, stating the requirement from the 1904.40(a).
