OSH ACT of 1970 Section (5)(a)(1):The employer is failing to furnish a place of employment that is free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees are exposed to struck-by and caught-in-between hazards.  The employer is failing to prevent employee exposure to struck-by and caught-in between hazards.  On or about July 29, 2021 at 1616 Woodson Road, Overland, Missouri, employees work in the fall shadow of stone slab bundles that weigh approximately 4,902-6,536 pounds during the shipping container unloading process.  Employees enter the fall shadow to remove wooden shipping bracing that previously stabilized each bundle in an upright and secure position. The bracing removal process destabilizes the load creating a struck-by or caught-in-between hazard when employees are in the fall shadow.  An employee suffered a fatal injury when struck and caught in between destabilized bundles of stone slabs during the unloading process.

At 1616 Woodson RD, Overland, MO 63114 - On or about July 29, 2021 and at times prior thereto, Universal Granite & Marble of Missouri INC did not have each affected employee use a type of PPE that would protect the affected employee from the hazards identified to include flying debris and struck-by hazards.

At 1616 Woodson Rd, Overland, MO 63114 - On or around July 29, 2021, Universal Granite & Marble of Missouri INC, had not ensured that each powered industrial truck (forklift) operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the reevaluation/training.  The last records and reevaluation/training were dated November 20, 2017.

29 CFR  1904.39(a)(1): Within eight (8) hours after the death of any employee as a result of a work-related incident, the employer did not report the fatality to the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor.  At 1616 Woodson RD, Overland, MO 63114 - On or about July 29, 2021 an employee of Universal Granite & Marble INC was fatally injured.  Management officials became aware of the employee being pronounced dead at approximately 6:00 PM on July 29, 2021.  Employer did not report fatality to OSHA until 9:15 AM on July 30, 2021.
