29 CFR  OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crush by hazard:  At a residential worksite located at 15905 Richmond Ave, Belton MO -- The employer is failing to protect employees from crush by hazards.  An employee performing tree removal operations using a Bobcat MT52 Mini Track Loader, PIN 523611280 with fork attachment, was operating on a slope with forks raised overhead and over the maximum weight capacity when the MT52 tipped forward crushing the victim. Instances of failure include, but not limited to:   a. Operator driving MT52 with the forks raised while driving downhill.  b. Operator driving MT52 over the maximum weight capacity of 520 pounds.

29 CFR  1910.133(a)(1):Protective eye equipment was not required where there was a reasonable probability of injury that could be prevented by such equipment:  The employer is failing to protect employees from struck-by hazards. This was most recently documented on or about August 8, 2021, at a residential worksite located at 15905 Richmond Ave, Belton, MO. Employee were exposed to struck-by hazards in that employees were not wearing eye protection while performing and working in near proximity to sawing, falling limbs, branches, and twigs, and moving cut limbs, branches, and debris.

29 CFR  1910.135(a)(1):The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects:  The employer is failing to protect employees from struck-by hazards. This was most recently documented on or about August 8, 2021, at a residential worksite located at 15905 Richmond Ave, Belton, MO were exposed to struck-by hazards in that  employees did not use head protection in the form of hard hats. Employees were working directly under trees  and a truck mounted boom and bucket during trimming work. The employees were exposed to potential falling objects including branches, tools and debris.
