29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: a) Hubbard Feeds Inc. located at 104 Oak St Botkins, Ohio; on or about August 17, 2021, and at times prior, employees were exposed to fall hazards of approximately 30 feet while standing near the edge of a 10 feet wide loading platform opening during pellets feed loading and unloading operation.

29 CFR 1910.212(a)(1):One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a) Hubbard Feeds Inc. located at 104 Oak St Botkins, Ohio; on or about August 17, 2021, the employer did not ensure that the pinch point associated with the Rotex 480 V center mill shaker's chain in bins 64 and 65 on the second level was adequately guarded. Employees were exposed to amputation injuries from a pinch point created between the chain and the motor gears when the motor is actuated.

29 CFR 1910.272(j)(2)(ii): Fugitive grain dust accumulations were not removed whenever they exceed 1/8 inch (.32 cm) at priority housekeeping areas, pursuant to the housekeeping program, or shall demonstrate and assure, through the development and implementation of the housekeeping program, that equivalent protection is provided. a) Hubbard Feeds Inc. located at 104 Oak St Botkins, Ohio; on or about August 17, 2021, and at times prior, employees working in the building hosting bins 64 and 65 were exposed to fire and explosion hazards. Dust was allowed to accumulate greater than 1/8 inch deep in the west side of the second level of the loading platform and the north side of the bins 64 and 65 gates.

29 CFR 1910.303(b)(1)(viii): Electrical equipment was not free from recognized hazards based on other factors that contribute to the practical safeguarding of persons using or likely to come in contact with the equipment: a) Hubbard Feeds Inc. located at 104 Oak St Botkins, Ohio; on or about August 17, 2021, and at times prior, electrical equipment under the leaking roof was not kept free from hazards, exposing employees to electrical shock and fire hazards. The Rotex 480 V north pellet shaker's power cord, plug, and an electrical box were not contained in an enclosure or free from water leaking from the damaged roof on the bin's second level.
