29 CFR 1910.147(c)(1):The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: (a) Maintenance shop; on or about August 19, 2021, and at times prior thereto, the employer exposed employees to crushed-by hazards in that employees were allowed to perform maintenance and servicing on equipment without having a lockout program, without being trained in lockout tag out, and without machine specific lockout tag out procedures.

29 CFR 1910.147(c)(4)(i):Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: (a) Maintenance shop; on or about August 19, 2021, and at times prior thereto, the employer exposed employees to crushed-by hazards in that employees were allowed to perform maintenance and servicing on the Prentice 2764 tractor, which has multiple energy sources such as hydraulics and gravity, without those employees having a written machine specific lock out procedure to ensure that those energy sources were controlled while the employees were performing maintenance on, or servicing the machine.
