(a)  On or about August 30, 2021, the two hand control buttons located underneath the wooden table on the Federal #7 partial revolution 80 ton press Serial #7-653 were not protected by ring guards.

29 CFR  1910.217(b)(13):  Control reliability. When required by paragraph (c)(5) of this section, the control system shall be constructed so that a failure within the system does not prevent the normal stopping action from being applied to the press when required, but does prevent initiation of a successive stroke until the failure is corrected. The failure shall be detectable by a simple test, or indicated by the control system. This requirement does not apply to those elements of the control system which have no effect on the protection against point of operation injuries.  (a)  On or about August 26, 2021, an employee was injured at the point of operation of Federal #7 partial revolution 80 ton press Serial #7-653 due to the lack of a control reliability system, such as but not limited to check valve, anti-repeat feature, anti-tie down feature, and multiple relays.

29 CFR  1910.217(c)(1)(i):  It shall be the responsibility of the employer to provide and insure the usage of "point of operation guards" or properly applied and adjusted point of operation devices on every operation performed on a mechanical power press. See Table O-10.  (a)  On or about August 26, 2021, the Federal #7 partial revolution 80 ton press Serial #7-653 where employees were performing hand in die operations did not have adequate point of operation guards in place, in that the guard in place was open and not in use to prevent repeat strokes.

29 CFR  1910.217(b)(14)(i):  Be so constructed as to automatically prevent the activation of a successive stroke if the stopping time or braking distance deteriorates to a point where the safety distance being utilized does not meet the requirements set forth in paragraph (c)(3)(iii)(e) or (c)(3)(vii)(c) of this section. The brake monitor used with the Type B gate or movable barrier device shall be installed in a manner to detect slide top-stop overrun beyond the normal limit reasonably established by the employer.    (a)  On or about August 26, 2021,  the Federal Press #7 part revolution Serial #7-653 utilized as hand in die operation did  not have a brake monitoring system.

29 CFR  1910.217(e)(1)(i):  It shall be the responsibility of the employer to establish and follow a program of periodic and regular inspections of his power presses to ensure that all their parts, auxiliary equipment, and safeguards are in a safe operating condition and adjustment. The employer shall maintain a certification record of inspections which includes the date of inspection, the signature of the person who performed the inspection and the serial number, or other identifier, of the power press that was inspected.  (a)  On or about August 26, 2021, the employer did not establish a program to conduct periodic and regular inspections of the Federal Press #7 80 ton partial revolution Serial #7-653 to ensure that all its parts, auxiliary equipment, such as but not limited to point of operation guard, two hand controls, anti-repeat feature and anti-tie down feature were in safe operating condition.

29 CFR  1910.217(f)(2):Instruction to operators. The employer shall train and instruct the operator in the safe method of work before starting work on any operation covered by this section. The employer shall insure by adequate supervision that correct operating procedures are being followed.  (a)  On or about August 26, 2021, the employer did not train operators on the safe operation of the Federal Press #7 80 ton part revolution Serial # 7-653 in that operators were not informed of the type of mechanical power press they were operating to include the safety features necessary for hand in die operations on part revolution presses.
